Dispute Resolution

Litigation can be a very complex and expensive experience especially if you are the losing party.  At Charles and Co we attempt to resolve matters where possible without resorting to lengthy and expensive court proceedings.

From the outset, we will outline the anticipated cost range and options so you can make an informed choice and have the support you need, exactly where you need it. We strongly recommend that as an initial step Alternative Dispute Resolution (ADR) is explored as a potential avenue for resolving disputes before taking legal action. We are happy to help clients as an intermediary to attempt to resolve matters at the earliest possible stage by arranging meetings between the parties and appointing a suitable mediator.

If it is not possible to resolve the dispute without legal action, we will take care of everything; from pre-action disclosure all the way to final trial and enforcement of any Judgement. We always use specialist barristers and experts to advise at the initial stages so that any weakness in your case can be identified early on and if advised, proposals can be made in relation to a settlement avoiding the escalation of costs for all parties.

We can advise and have extensive experience on the following areas of law:

Property litigation

Disputes over ownership of property including Trust of Land and Appointment of Trustees Act 1996 (TLATA) claims.

These claims can also arise in the context of financial relief claims in matrimonial proceedings where a non-party wishes to intervene in those proceedings to obtain a declaration as to co-ownership and possibly a transfer of the property in dispute.

Boundary/Nuisance Disputes

Boundary and Party Wall disputes can be very complex and expensive. If you are disputing a Party wall Notice or taking issue with neighbours over a right of way or the boundary / encroachment / trespass of property we can assist with dealing with all the complexities surrounding such matters.

Probate litigation

We can advise and assist with pre-death issues including disputes over lifetime transactions, property ownership etc. Claims involving dependents under the Inheritance (Provision for Family and Dependents) Act 1975 and disputes with regard to the validity of a Will. Grant of Probate and the administration of the Estate.

General Commercial Disputes

If your customers owe you money for goods and services rendered, we can deal with pursuing such claims. We deal with serving, statutory demands, insolvency proceedings or if so advising serving letters before action and then pursuing debtors through the courts.
