Whenever the court is asked to intervene to decide questions relating to a child, the welfare of the child is paramount. 

The court can make the following orders: 

Regulating where a child should live (and with which parent)
Regulating contact between the child and the non-resident parent
About specific issues relating to the child, for example where he/she should go to school or about medical treatment where the parents cannot agree – a "specific issue order"; and
"Specific issue Orders”: These are orders that can be made to resolve an issue in dispute relating to the child, for example where he/she should go to school or about medical treatment. This mechanism can also be used by parents seeking permission to relocate their child within England and or Wales or abroad when agreement cannot be reached via Alternative Dispute Resolution.
"prohibited steps order": These are orders prohibiting certain actions where the parents cannot agree, for example preventing a parent from relocating with the child to a different location within England or from removing a child from England and or Wales.

How does the court decide disputes

The courts approach will be influenced by the Welfare checklist

The wishes and feelings of the child or children concerned (this is concerned in light of the child's age and understanding)
The child's physical, emotional and educational needs
The likely effect on the child of any change in their circumstances
The child's age, sex, background and any other characteristics which the court considers relevant
Any harm which the child has suffered or is at risk of suffering
How capable each of the child's parents (or any other relevant person) is of meeting the child's needs
The range of powers available to the court in relation to the proceedings

Are children’s views taken into account

There is no doubt that children are affected by inter parental conflict and this can lead to different types of symptoms depending on the age of the child eg: sleep disturbance, self blame/harm, anxiety, academic problems to name a few. We at Charles & Co are keen to ensure that lawyers do not add to this distress and are mindful of the impact of prolonging proceedings.

The key message from research (Nuffield Family Justice Observatory) on children’s involvement in parental disputes is:

Most children feel powerless in situations of family change
Parental separation can be distressing, traumatic and confusing for children

Being heard and understood in court can feel empowering
